Guidelines for course of action by workers/CGI/Saudi Authorities pertaining to various Exit cases

Non-Domestic Workers(Working in Companies)

Requirements

1. Expired Iqama should have been issued at Jeddah

2. Company must be in Red Category

3. Passport Copy

4. Iqama Copy

 

Remarks

1. The company should not be in Green Category

2. There should not be any Police Case / Court Cases pending against the worker

3. Whether or Not completed the Contract

Collect all the required papers.

Consulate sends the list of workers seeking Exit to the Deportation Center in Shumaisi

They will process the papers

 

Register your request for Exit online at https://cgijeddah.org/consulate/exitvisa/reg.aspx

On receipt of the clearance from the Deportation Center by the Labour Office. Indian Consulate completes the formalities at the Labour Office.

Deportation Center checks for any Police case against the worker.  In case of NO case against the worker, Deportation Center sends Clearance papers to Saudi Labour Office

 

On receipt of the Clearance, complainant exits KSA

On receipt of the clearance, physically, from the Labour Office in Hamadaniyah,  Indian Consulate approaches the Deportation Center once again to grant final Exit Permit.

The Labour Office approaches the Sponsor to grand NOC within 04 working days. On grant of NOC by sponsor, Saudi Labour Office issues the Clearance for Deportation Center.

 

NOTE: In case of Worker does not attend the Hearings, the Court may have adverse verdict on the case.

Indian Consulate keeps track of the papers and follows up with the Saudi Authorities to expedite the clearance.

On the basis of the Clearance from the Labour Office, Deportation Center issues the Exit Permit.

 

NOTE: In case of No Exit after clearance, the complainant may face further legal process.

On receipt of the final Exit Permit, Indian Consulate informs the worker and hands over the Exit Permit to him/her.

 

 

 

Note: In cases falling under this category in cities other than Jeddah, Indian Consulate issues letter addressed to the Labour Office for other Cities.

 

2.

Domestic Workers (Working at Residences)

House driver,

House maid,

House nurse,

House worker,

shepherd, etc.

Requirements

1. Iqama should have been issued at Jeddah

2. Passport copy

3. Iqama Copy

Remarks

1. No need of company category/zone

2. Whether or Not completed the Contract

Collect all the required papers

Provides Form of the Labour Court to the Worker

File is opened in the Labour Court

 

Register your request for Exit online at https://cgijeddah.org/consulate/exitvisa/reg.aspx

Attend Hearings with the Worker at the Labour Court, Jeddah

If NO case against the worker, Court will summon the sponsor to one or number of hearings in the Court.

 

Fill in the Form given by the Indian Consulate

Attend Labour Court for the Court’s Verdict

Labour Court passes the Verdict

 

Take the filled in Form to the Labour Court in Kandara, Jeddah

Guide the Worker to the Deportation Center

A copy of the Verdict is handed over to the worker.

 

Attend Hearings at the Court

Assist Worker at the Deportation Center for Finger Print

The verdict may be in favour of the Sponsor. In case of no financial implication on the sponsor, Court may ask the Deportation Center to process for Exit.

 

The sponsor may file Huroob / Absconding case against the worker.

After Finger Print, request Deportation Center for Exit Permit.

 

 

Huroob / Absconding charge to be challenged in Labour Court

 

 

 

After Court Verdict, go to the Deportation Center for Finger Printing

 

 

 

Deportation Center issues the final Exit, proceed to India

 

 

 

NOTE: In case of Worker does not attend the Hearings, the Court may have adverse verdict on the case.

 

 

 

NOTE: In case of No Exit after clearance, the complainant may face further legal process.

 

 

 

 

 

 

3.

Huroob / Absconding

Domestic and Non-Domestic Workers

Requirements

1. Iqama should have been issued at Jeddah

2. Passport copy

3. Iqama Copy

Remarks

1. Category of the company does not matter

2. Whether or Not completed the Contract

3. Whether Iqama valid or not

4. Immediate return for reemployment after Exit with Huroob may not be possible.

Collect all the required papers

Consulate sends the list of workers seeking Exit to the Deportation Center in Shumaisi

Deportation Center checks for any Criminal cases against the worker.

 

Register your request for Exit online at https://cgijeddah.org/consulate/exitvisa/reg.aspx

After appointment is granted by the Deportation Center, inform workers

If no Criminal cases, Deportation Center grants appointment for finger print

 

NOTE: In case of Worker does not attend the Hearings, the Court may have adverse verdict on the case.

Assist Worker at the Deportation Center for Finger Print

Issues Exit Permit

 

NOTE: In case of No Exit by the worker after clearance, the complainant may face further legal process.

After Finger Print, request Deportation Center for Exit Permit.

 

 

 

 

 

4.

Criminal Cases

Domestic and Non-Domestic Workers

Requirements

1. Iqama should have been issued at Jeddah

2. Passport copy

3. Iqama Copy

Remarks

1. Irrespective of the category of the company, worker faces court proceedings.

2. Whether or Not completed the Contract

 

Role of the Complainant

Collect all the required papers

Provide translation support in Court

Court Proceedings

 

Prepare for Court hearing to support the case with evidences

 

 

 

Worker goes to the Labour Court and attend hearing(s)

 

 

 

In advance, inform Consulate of the date of next hearing

 

 

 

After the Court verdict, go to the Deportation Center for Finger Print for Exit

 

 

 

NOTE: In case of Worker does not attend the Hearings, the Court may have adverse verdict on the case.

 

 

 

NOTE: In case of No Exit by the worker after clearance, the complainant may face further legal process.

No Salary & End or Service Benefits / Not Renewing Iqama / Physical Violence and Extended working hours with financial benefits

1. Irrespective of the category case has to be filed against the sponsor

2. Whether or Not completed the Contract

Files a case against the sponsor

Attend Hearings with the Worker at the Labour Court

Attend Court hearings

Attend Labour Court for the Court’s Verdict

Labour Court passes the Verdict

 

Submit Final Verdict in the Implementation Court

 

A copy of the Verdict is handed over to the worker.

 

Wait till the amount is released
