Guidelines and requirement of documents for Death Compensation

DOCUMENTS REQUIRED FOR PURSUING THE CASE OF DEATH COMPENSATION IN PUBLIC COURTS OF SAUDI ARABIA ON BEHALF OF THE LEGAL HEIRS OF THE DECEASED

Legal Heirship Certificate (LHC) and Power of Attorney (POA) are the two documents required in Saudi Public Courts to claim death compensation on behalf of legal heirs of the deceased person.

 

  1. LEGAL HEIRSHIP CERTIFICATE (LHC)

This certificate is issued by the competent authorities of respective State Government in India like Tehsildar/Mandal/District Collector/ District Magistrate/Civil Judge, etc.  The certificate should indicate

names in FULL EXPANDED FORMS (without initials) of all legal heirs including minor children. Age and relationship with the deceased person should also be mentioned.

2. POWER OF ATTORNEY (POA)

This should be signed and executed by all the legal heirs including minor children mentioned in Legal Heirship Certificate.  Persons who can not sign should put thumb

impression (male – left thumb and female – right thumb).  On behalf of minor children, their Guardian must sign the document. 

 

Power of Attorney should be executed in favour of any relative/friend/ neighbor/representative in Saudi Arabia/Saudi sponsor or any other person who can attend the court proceedings. 

If you wish to nominate this Consulate as your legal representative, the Power of   Attorney should be executed in favour of Consulate General of India, Jeddah with powers to nominate any

IMPORTANT :

1.

Both the documents (LHC & POA) should be prepared in English and later translated to Arabic.  The English & Arabic versions should be got attested from the authorities mentioned below in India before sending/submission to the courts in Saudi Arabia.   This attestation is mandatory legal requirement in Saudi Arabia and incomplete documents without attestations are rejected by the Courts in Saudi Arabia.

2.

Formats of LHC & POA as accepted by Saudi Public Courts are enclosed.  Therefore, changes in the language of LHC & POA should NOT be made.  

3.

Copy of Passport or the Aadhaar Card must be provided with the above documents.

Saudi Ministry of  Foreign Affairs, Riyadh or Jeddah

Ministry of Justice, Riyadh or Jeddah.
